
*If the property owner has a desire to build a fence which does not meet these minimum guidelines, he or she should request approval of the President of the Civic Association in writing. The reason for this is safety and visibility. Also, it should be no closer that 12” from the curb or gutter. However, any hedge in continuous form, which extends beyond the front line of the house towards the front line of the property, can be no higher that 3’.

*In the case of hedges, there is no limit as to height if at the rear of the house. Fences higher than 4’ should be placed a minimum of 12” from any mutual property line. *Any fence 4’ or less in height should be placed so that it is a reasonable distance from the mutual property lines as to permit access by the owner of the fence for maintenance purposes, without trespassing upon his neighbor’s property. *No fence, regardless of height, shall be placed closer to the street than 60” on a property front and 40” on a property side if the property is a corner one. *For the purposes of these guidelines, a fence is defined as a continuous barrier constructed of wood, metal, stone, or plastic and more that 40 feet long. Please also note the New Castle County regulations regarding fencing, available in the Codes tab above. With this in mind, we have prepared the following guidelines which we believe are reasonable and flexible enough so that the individual who wishes to surround his or her property with a fence can do so with a fair degree of freedom.


Fences can only detract from this beauty if allowed to be constructed without some reasonable semblance of order as to height and location. This, we are sure, was one of the reasons you chose to live in Surrey Park.
